Terms of Service
Effective date: 1 January 2025
1. Acceptance of terms
These Terms of Service ("Terms") form a legally binding agreement between you and Mindacks Global Pvt Ltd ("MHCAI", "we", "us"). By accessing mhcai.org, creating an account, or enrolling in any programme or certification, you agree to be bound by these Terms and our Privacy Policy.
If you are using our Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Our services
MHCAI provides:
- Online and in-person AI education programmes and academies
- Professional certifications in AI, responsible AI, and related disciplines
- Live workshops, masterclasses, and cohort programmes
- Corporate training engagements
- Free and paid educational resources
We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of Services.
3. Accounts
To access paid Services, you must create an account. You agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at legal@mindacks.com if you suspect unauthorised access.
Accounts are personal. You may not share login credentials or transfer your enrolment to another person without our written consent.
4. Enrolment, payments, and refunds
4.1 Enrolment
Enrolment in a paid programme constitutes a contract. Access to programme materials is granted upon receipt of cleared payment.
4.2 Pricing
Prices are displayed in Australian Dollars (AUD) unless otherwise stated. We reserve the right to change prices with 30 days' notice. Changes do not affect existing confirmed enrolments.
4.3 Refunds
- Self-paced programmes: full refund if requested within 14 days of enrolment and less than 20% of content has been accessed.
- Live cohort programmes: full refund if cancellation is made more than 7 days before the programme start date. No refund for cancellations within 7 days of start, except at our discretion in extenuating circumstances.
- Certifications: assessment fees are non-refundable once an assessment attempt has been made.
- Corporate engagements: governed by the specific statement of work.

5. Intellectual property
5.1 Our content
All content on mhcai.org — including course materials, videos, assessments, frameworks, certification logos, and the MHCAI brand — is owned by or licensed to Mindacks Global Pvt Ltd and protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
5.2 Licence to you
Upon enrolment, we grant you a personal, non-transferable, non-exclusive licence to access and use the relevant programme materials for your personal educational use during the access period of your enrolment.
5.3 Your content
Any materials you submit (assignments, forum posts, feedback) remain yours. You grant us a non-exclusive licence to use such content for educational and quality improvement purposes within our Services.
6. Certifications
MHCAI certifications are awarded on the basis of demonstrated competency through assessment. We reserve the right to revoke a certification where evidence of cheating, misrepresentation, or serious misconduct is found. Certified professionals must comply with the MHCAI Code of Professional Conduct (available on request).
Digital badges are issued via our badging platform. You may display them on LinkedIn and professional profiles. Badge verification is publicly accessible to employers.
7. Acceptable use
You agree not to:
- Share programme access, login credentials, or materials with third parties
- Use our Services for any unlawful purpose
- Attempt to reverse-engineer, scrape, or copy our platform or content at scale
- Misrepresent your identity or credentials in assessments
- Harass, threaten, or abuse other learners, facilitators, or staff
- Use AI tools to complete assessed work without disclosure (where prohibited by programme rules)
We may suspend or terminate your access without notice for serious violations, and with 14 days' notice for lesser violations if uncorrected.
8. Corporate training
Corporate training engagements are subject to a separate Statement of Work (SOW) agreed between MHCAI and the client organisation. In the event of conflict between the SOW and these Terms, the SOW prevails for that engagement.
9. Disclaimer of warranties
Our Services are provided "as is" and "as available". We do not warrant that the Services will be uninterrupted, error-free, or meet your specific requirements. We make no guarantees regarding employment outcomes, salary increases, or career advancement resulting from use of our Services, though we publish outcome data where available.
10. Limitation of liability
To the maximum extent permitted by law, Mindacks Global Pvt Ltd's total liability to you for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
11. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under ACICA rules, or the courts of New South Wales where arbitration is not applicable.
12. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on our website at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
